New York Tax Deed Sales Process

There are 62 counties in the state of New York. Tax collections are handled at the county level and by the cities and municipalities that have charters and provisions for the collection of  taxes. Tax lien certificates can be sold, as is the case in New York City and Nassau County. Both counties and cities authorize public auctions. Sales are usually conducted in April or August, but the dates can vary. Many counties and municipalities in New York retain a private firm to handle tax sales and auctions.

Legal age requirements, which differ for different classes of properties, refer to the age of the oldest tax lien on an individual property’s balance. For Class 2 (multiple dwellings, excluding cooperatives and condominiums), Class 3 (utility properties), and Class 4 (commercial, industrial) properties, a property’s entire balance of delinquent charges is eligible for sale once the oldest tax lien remains unpaid for at least one year.

For Class 1 (one thru five family homes) and Class 2 (residential condos and co-ops) properties, a property’s entire balance of delinquent charges is eligible for sale once the oldest tax lien remains unpaid for at least three years. 

Some municipalities (e.g., New York City) do not offer liens for sale to individual investors or the general public. Check the rules in your area. Also, sales can be crowded.
